Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: a) On or about 5/5/05-9/7/05, the Old Engine room was not provided with tight fitting doors, as required by ANSI/ASHRAE 15-1978, Section 11.13.5 b) On or about 5/5/05-9/7/05, the Old Engine room and the New Engine Room had openings other than doors that would permit passage of escaping refrigerant to other parts of the building. Both engine rooms had numerous holes in the walls ranging up to 12" in diameter, which is prohibited by ANSI/ASHRAE 15-1978, Section 11.13.5. c) On or about 5/5/05-9/7/05, the Old Engine Room was not provided with either a continuously operated, independent mechanical ventilation system, an independent mechanical ventilation system actuated automatically by a vapor detector system when the concentration of ammonia in the room exceeds 25of the LEL, or electrical equipment which conforms to the requirements for Class 1 Division 2 locations as defined in the National Electrical Code, as required by ANSI/ASHRAE 15-1978 Section 7.4.
