T.C.A. 50-3-105(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: On October 12, 2004 the Memphis Fire Training Academy took inadequate precautions to prevent undue stress on recruits during the training exercises. One feasible abatement method, among others includes; Giving potential recruits a standardized physical fitness test immediately prior to starting a recruit training class (e.g., CPAT (Candidate Physical Ability or Agility Test.)) Developing a written training program for trainers of recruits that clearly state the purpose of the training and the safe manner in which the training will be conducted. Establishing mandatory hydration and periodic vital sign checks similar to the criteria used by fire units fighting a major fire for all recruits participating in the training. Placing an ambulance unit on site any time there is training in progress that might cause serious injury or illness. ABATEMENT VERIFICATION REQUIREDTION
