Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not provide safety and health training for the truck driver in the performance of his job duties. The following items should be addressed: 1. Specific training on the procedures for loading and unloading the trucks. 2. Specific training on the use of the hydraulic lift gate. 3. Specific training on the truck that is being used by that employee. 4. Specific training on inspecting the truck once it has been out for service and or maintenance. On March 29, 2005 an employee was preparing to load motorcycles onto a tractor trailer. The employee was standing underneath the lift gate while using a hand held control. The employee was fatally injured when the lift gate came down and struck him.
