Text For Citation: 01 Item/Group: 001 Hazard: STRUCK BY
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by falling materials during offloading: a).On or about June 21, 2006 a truck driver employee standing adjacent to his load was exposed to the hazard of being struck by falling pipes 44 feet in length, 9 5/8 inches diameter and weighing 2343 pounds each, during the offloading operations. Among other methods, feasible and acceptable methods to abate this hazard would be to follow practices used by companies and/or corporations which perform similar delivery operations by: (1) establishing and implementing a policy that requires all drivers to remain in a safe zone, outside the radius of work in progress; (2) to include documented periodic spot checks to ensure that truck drivers are adhering to established safety requirements; and, (3) to enforce the company's Accident Prevention Procedures as outlined in the Safety Manual by investigating accidents and near misses in order to implement appropriate corrective and/or preventative measures. *** Certification and Documentation of Abatement Required ***
