Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing and struck-by hazards in the event of a forklift tip over: In the Alternative: 29 CFR 1910.132(a): Protective equipment, including personal protective equipment for eyes, face, head and extremities, protective equipment, and protective shields and barriers, were not provided, used and maintained. a.On or about May 13, 2006, the employer did not ensure or have in affect a policy that employees use/wear the installed seatbelt when operating a GEHL 6000 pound all terrain forklift, model 663, serial #114366. One feasible and acceptable abatement method, among others, to correct this hazard would be enforce the use of seatbelts as required by the equipment manufacturer and ASME B56.1-2000, Safety Standard for Low Lift and High Lift Trucks. *** Certification and Documentation of Abatement Required ***
