Minn. Stat. 182.653 subd. 2: The employer did not furnish to each employee, conditions of employment and a place of employment free from recognized hazards which caused or were likely to cause death or serious injury to employees: An employee was exposed to a fall hazard of approximately 19 feet while working in a basket attached to an all-terrain forklift without wearing a personal fall arrest system and the basket extended out past the wheelbase by more than 10 inches on each side.
