Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: October 4, 2005 at the Bloomington, IL jobsite. Employees were exposed to struck-by and caught-in hazards while working/working around a Caterpillar 325C excavator. The swing radius was not protected. Among the feasible means of abatement would be to comply with the Association of Equipment Manufacturers for Hydraulic Excavators requirements for swing radius protection.
