Text For Citation: 01 Item/Group: 001 Hazard: STRUCK BY
North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by a falling concrete wall: a)recycle goods area, 2/8/05, a community service worker was struck by a concrete barrier panel that was overturned by an employee operating a Bobcat skid steer loader. Employees were assigned to work in the area where the accident occurred when no community service workers were available, exposing employees to the overturning wall hazard. Among other methods, a feasible and acceptable abatement method to correct this hazard is to: (a) when #740 "L" panels are installed together, bolt the panels together to increase stability and (b) set up panels so that the tongue and groove fittings appropriately match up and (c) train Bobcat skid steer loader operator to enter straight into recycle bin and maintain a safe distance from the barrier panels.
