Title 40.1-51.1(a), Code of Virginia: The employer did not furnish to each of its employees safe employment and a place of employment which was free from recognized hazards that are causing or are likely to cause death or serious physical harm in that: Employer exposed employee(s) to fall hazards of 20 feet, by allowing employee(s) to operate the Sunbelt 400S JLG lift with three employee(s) inside the basket which exceeds the manufactures recommended weight limit. Combined weight of the three employee(s) along with the tools and materials exceeded the 500 pound weight limit required by the manufacture. This occurred while three employee(s) were inside the basket, two of the employee(s) were being transported to the roof level at the front of the building. One feasible way to abate the above hazard would be for the employer to assure compliance with the Sunbelt Manufactures recommendations which states "Do not exceed the platform capacity indicated on the capacity indicator located on the platform control console. On units with inoperative or defaced capacity indicators, do not exceed 500 pounds maximum platform capacity."
