Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by an asphalt vibratory compactor: 1.On August 11, 2005, an employee was reversing an asphalt vibratory compactor when the equipment struck and killed another employee who was working on ground level. Among other methods, one feasible and acceptable abatement method is to keep all workers clear of the rear of backing vehicles, and to ensure that the area to be compacted is free from workers.
