Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall and struck-by injuries: a.On or about March 18, 2005, employees were elevated on the forks of a forklift to view the upper tiers of the boat storage area, and to lubricate the forklift, ranging from 12 to 60 feet above the ground. The employees used a personal fall protection system anchored to an eye ring on the forklift. This practice was not approved by the manufacturer and exposed employees to a fall hazard and potential fall protection system failure and/ or equipment tip over hazard. Among other methods, one feasible means of abatement would be: Contacting the manufacturer and obtaining an approved safety platform that would enable the employees to perform the necessary job functions. ABATEMENT CERTIFICATION IS REQUIRED.
