Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: On or about 11/10/04, employees loading the John Deere 862 B scraper onto the staging platform of the "drag" in preparation for transport were exposed to being crushed or struck by shifting or movement of the equipment being loaded when performing duties within the framework of the drag and, potentially, within the path of travel while equipment was running and not chocked or otherwise secured. Among other methods, feasible and acceptable means for abating this condition include preparing and securing equipment for transport in accordance with the manufacturer's specifications.
