Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Struck by hazard: On or about 10/11/05, at 145th Avenue and Miramar Parkway, employees were not wearing high visibility vests while working and walking in a roadway, exposing them to a struck by hazard by motor vehicles and/or being struck by a backhoe in use. IN THE ALTERNATIVE 29 CFR 1926.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: On or about 10/11/05, at 145th Avenue and Miramar Parkway, the employer did not ensure that high visibility vest were provided and used by employees exposed to struck by hazards while walking and working in a roadway and while working near a backhoe.
