Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Being struck by vehicular traffic while working in a road. Among other methods, one feasible method of abatement would be to wear a reflective warning vest. On or about 8/17/05, a)While operating a Stihl blower machine on Glades Road, employee was exposed to being struck by vehicular traffic while working without wearing a reflective warning vest.
