Section 5(A)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm to employees in that employees were exposed to a struck by hazard: On or about 07/14/2005, an employee was not wearing a high visibility vest while selling newspapers near moving motor vehicles. Among other methods of abatement, a feasible and acceptable method to correct this hazard is to enforce the use of high visibility vests. In the Alternative: 29 CFR 1910.132(a): On or about 07/14/2005, an employee was not wearing a high visibility vest while selling newspapers near moving motor vehicles.
