Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to tripping and fall hazards: (a)On or about 04/26/05, dock workers were required to load delivery trucks in bays 1 & 2 without the use of functioning dock boards. The bay 1 dock board had a section missing and the bay 2 board had a broken operating chain. Lift trucks are required to drive close to the dock edge so as to place pallets into the trucks and are subject to falling into the space between the dock and truck. Also, workers rolling shipping containers or hand carrying freight into the trucks are subject to tripping and fall hazards. Among other methods, feasible and acceptable methods to correct this hazard are to either repair the existing dock boards or install acceptable dock plates when loading trucks.
