Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a crushed by hazard: On or about 03/21/05, employees were operating a Clark forklift, Model GC 515, SN G127- 1320-7228KOF that was not equipped with a seat belt.
