Text For Citation: 01 Item/Group: 001 Hazard: LIFTING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a fall hazard: On or about 11/16/04: Tropicana Parking Garage auto ramp, between levels 2 and 4 - The employer did not ensure that employees operating mobile scaffolds (scissors lifts) such as but not limited to a JLG Model 2033E, follow the manufacturer's recommendations. Among other methods, feasible and acceptable methods to correct the hazard are: 1)Assure that the JLG Model 2033E Operators & Safety Manual procedures such as but not limited to are followed by employees with no deviation: Section 1 paragraph 6 "Safety Precautions,Operation" - "Ensure machine is positioned on a firm, level and uniform surface before raising the platform". Section 4 paragraph 4 "Raising and Lowering (Lifting)" - "Do not raise the platform except on a hard, level surface free of obstructions and holes". 2)Develop and implement a policy that operators read and understand manufacturer's safety manuals and operator manuals before operating mobile scaffolds (scissors lifts). NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM, FAILURE TO DO SO WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 AS PER 29 CFR 1903.19.
