Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to a falling hazard by the lack of a restraining means when riding on a work platform attached to the forks of a Caterpillar vehicle. Among other methods, one feasible and acceptable abatement method to correct the hazard is to provide some type of restraining means (railings) to prevent falling from the platform. 9 MORSE VILLAGE RD, WENDELL, MA, LIBRARY SITE: AN EMPLOYEE WAS RIDING ON THE WORK PLATFORM ATTACHED TO A CATERPILLAR VEHICLE WITHOUT THE USE OF SOME MEANS OF FALL PROTECTION.
