Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to possible injuries caused by the hydraulic rotary actuator mechanism/associated parts and/or other moving parts of the machinery that are not being properly maintained: (a) LAUNDRY AREA -- ON OR ABOUT 9/28/05, AN EMPLOYEE WAS STRUCK BY THE OVERHEAD DOORS ON A G.A. BRAUN 900 LB., MODEL 900NOTUVP-4, SERIAL #NOTUVP90094001, OPEN POCKET HYDRAULIC SIDE LOADER, WASHER- EXTRACTOR, WHEN THE HYDRAULIC ROTARY ACTUATOR MECHANISM/ASSOCIATED PARTS FAILED. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE ABATEMENT METHOD TO CORRECT THIS HAZARD, WOULD BE TO COMPLY WITH THE AMERICAN NATIONAL STANDARD FOR COMMERCIAL LAUNDRY AND DRY CLEANING OPERATIONS, ANSI Z8.1-1996, SECTION 5.2 MECHANICAL PRECAUTIONS, SPECIFICALLY 5.2.1 FOR DEFECTIVE EQUIPMENT, IN THAT NO MACHINE SHALL BE OPERATED WITH ANY GUARD OR COVER MISSING OR WHEN IN NEED OF REPAIR OR ADJUSTMENT, OR IN A CONDITION THAT MAY BE HAZARDOUS TO THE OPERATOR OR ANY OTHER PERSON. IF AN OPERATOR NOTICES ANY MALFUNCTION OF A MACHINE, HE OR SHE SHALL IMMEDIATELY STOP THE MACHINE AND CUT OFF THE ELECTRICAL POWER AND THE COMPRESSED AIR OR HYDRAULIC SUPPLY TO THE MACHINE. THE OPERATOR SHALL NOT CORRECT THE CAUSE OF THE MALFUNCTION UNLESS SPECIFICALLY TRAINED AND AUTHORIZED TO SO. IN ADDITION, AS STIPULATED IN SECTION 5.2.2, IN ORDER TO MAINTAIN THE EQUIPMENT IN SAFE OPERATING CONDITION, ONCE A MONTH, OR AS SPECIFIED BY THE EQUIPMENT MANUFACTURER, ALL MOVING PARTS OF THE MACHINE, POWER TRANSMISSION COMPONENTS, BRAKES, AND ALL SAFETY DEVICES SHALL BE INSPECTED; IF NECESSARY, THEY SHALL BE CLEANED, LUBRICATED, AND ADJUSTED, OR REPLACED. IN ADDITION, MANUFACTURER'S MAINTENANCE INSTRUCTIONS SHALL BE ADHERED TO.
