North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by injuries: a)shop, Yale 1-ton hoist, load test and certificate were not conducted and maintained. One feasible and acceptable method to correct this hazard is to tests load with no more than 125percent of the rated load unless otherwise recommended by the manufacturer. b)shop, Yale 1-ton hoist system had a pendant control with no legible function labels nor markings. One feasible and acceptable method to correct this hazard is to repair or replace pendant control, per manufacturer's recommendation, to ensure safe operation of hoist.ion
