Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to a drowning hazard: (a) Opportunity Ponds RDU 8, D1-Cell: On or about January 6, 2006 an employee was building a dike on an unstable foundation when the dike collapsed into the pond. Among other methods, one feasible and acceptable abatement method to correct this hazard is to perform construction preparation similar to that performed in the past when constructing haul roads which would identify unstable foundation material; and then follow the procedures used when an unstable foundation is encountered when constructing hauls roads which would include either removing the soft material or adding stable material such as geotechnical fabric or additional fill material.l
