Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) On or about 03/11/05, an employee was exposed to a fall hazard while using a ladder of inadequate height to access a working level. A feasible and acceptable method to abate this hazard would be to ensure that all ladders used to access working levels extend three feet above the point of access and are secured to prevent tipping.
