Text For Citation: 01 Item/Group: 001 Hazard: FALLING

Section 5(a)(1) of the Occupational Safety and Health Act of 1970. The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employee in that employees were exposed to a fall hazard: a) 7 Adams Road, Martinsville, NJ 08836. The employer allowed his employee to start work without proper instruction on the use, inspection and maintenance of their equipment. In addition, the employer allowed his employee to don tree climbing equipment, climb tree and performed top out procedures without checking equipment for defects that could result in hazardous falls. Observed 4/20/05 Reference to #1) ANSI 4.1.2 - Employer shall instruct their employees in proper use, inspection and maintenance of tools and equipment, including ropes and lines, and shall require that appropriate working practices be followed. #2) ANSI 4.1.3 - A job briefing shall be performed by the qualified aborist in charge before the start of each job. The briefing shall be communicated to all affected workers. #3) ANSI 9.5.2 - Climbing spurs shall have gaffs of the type and length that are compatible for the tree being climbed. ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD, AMONG OTHER MEANS, WOULD BE FOR THE COMPANY TO ENFORCE THEIR EXISTING SAFETY AND HEALTH PROGRAM AND PROVIDE ADDITIONAL TRAINING BY A QUALIFIED ABORIST TO COVER JOB SITE PROCEDURES, MAINTENANCE AND SERVICING OF EQUIPMENT.
