Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards associated with flying debris: At this location in areas, such as, but not limited to, warehouse #2, employees involved in a bagging and support operation were exposed to the hazards of flying shards and piping in that the shop air was transported through this facility via schedule 40, Poly-Vinyl-Chloride (PVC) piping. Plastic piping is subject to failure when exposed to the pressures of compressed gasses. A means of abatement would be to replace the existing PVC piping with a type suitable for the transmission of compressed gasses.
