Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to tank covers that have the potential of collapsing or shifting resulting in falls that may cause serious injuries or death: Catalog Mill, Color Prep Area- The employer had not identified tank covers used as walking and working surfaces, such as the Hydrex Tank cover, as a hazard prior to the employees accessing the top of the tank. ABATEMENT NOTE: Among other methods, one feasible and acceptable method to correct this hazard is to: 1)Develop and implement a hazard assessment program to evaluate the tank covers as walking and working surfaces; 2)Develop and implement means to either prevent the tank covers from being used as walking and working surfaces if the assessment determines them to be hazardous, replace the covers if necessary or correct the hazardous conditions.
