Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to the hazard of potential fire and explosion because methods were not utilized to contain combustible, organic dusts created by manufacturing, handling, and processing operations from becoming airborne and combining with an ignition source: a) Stearate Area, L2 Room - On or about January 13, 2006 bagger room equipment including material hopper and auger-packer were not maintained under continuous suction thus allowing the escape of dust during normal operations. b) Stearate Area, L3 Room - On or about January 13, 2006 equipment in this area including material hopper and auger-packer were not maintained under continuous suction to minimize the escape of dust during normal operations. c) Flaker Area - On or about March 21, 2006 The product discharge area of the flaker machine was not maintained under constant suction to minimize the escape of dust during normal operations d) Slab-Dip Area - On or about March 21, 2006 the Slab-Dip Area Large mixing vat was not maintained under continuous suction to minimize the escape of dust during normal operations. Among other feasible methods one method to abate these hazards would be to ensure that organic powder processing areas of machinery are kept under negative pressure to the surrounding areas. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records. y
