Text For Citation: 01 Item/Group: 001 Hazard: FALLING

Section 6(a) of the Puerto Rico Occupational Safety and Health Act: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or physical harm to employees in that employees were exposed to: Seccion 6(a) de la Ley de Seguridad y Salud en el Trabajo de Puerto Rico: El patrono no proveyo empleo y un sitio de empleo libre de riesgos reconocidos que esten causando o que puedan causar muerte o dano fisico a los empleados, por cuanto empleados estaban expuestos a: a)Electric shock, fire and slips. At Farmacias El Amal, Aguadilla Shopping - Center employees were required to work in the store while rain water was dripping from different parts of the sealing falling into electrical equipment (lamps, panelboards, power conductors), counters and floor areas. The Puerto Rico Department had issued a temporally closing order of the facility on August 10, 2005 and a permanent closing order on August 12, 2005 because of the referenced conditions. The employer kept the employees working in the facility ignoring the hazards advise of the Puerto Rico Fire Department. At the time of the inspection; the employees were exposed to the same hazards. One feasible and available method to correct these hazards is to close the facility until: 1.The necessary sealing repairs are done 2.The electrical system is verify and determined to be safe by a licentiate electrician. a)Descarga electrica, incendio y resbalones. At Farmacias El Amal, Aguadilla Shopping Center se les requirio a empleados trabajar en la tienda mientras agua de lluvia estaba filtrandose por diferentes partes del techo cayendo sobre equipo electrico (lamparas, paneles y cables), anaqueles y areas de piso. El Cuerpo de Bomberos de Puerto Rico habia emitido una orden de cierre temporero del local el dia 10 de agosto de 2005 y una orden de cierre permanente el 12 de agosto de 2005 por las referidas condiciones. El patrono mantuvo a los empleados en el local ignorando los avisos de riesgo del Cuerpo de Bomberos de Puerto Rico. Al momento de la inspeccion los empleados estaban expuestos a los mismos riesgos. Un metodo disponible y viable para corregir estos riesgos es cerrar el local hasta que: 1.Se realicen las reparaciones del techo que sean necesarias. 2.El sistema electrico sea verificado y sea determinado como seguro por un perito electricista licenciado."
