Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employee(s), in that, ramp personnel were exposed to struck-by hazards from de-icing trucks: Ramp Area - Terminal C: On 12/7/04 an employee, while crossing the tarmac going to gate 21, was fatally struck by an FMC Tempest de-icing truck, that had restricted visibility enhanced by bad weather conditions. Vehicular and pedestrian traffic was intermingled, and not properly demarcated. Methods to correct the hazards include but are not limited to the following, alone or in combination: 1)Turn the holstered bucket sideways to afford the driver greater forward visibility, 2)Provide employees working on the aircraft ramp with approved Class 2 high visibility vests.lity
