Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to deficiencies in overhead hoists: (a) Welding Jig Area; The following deficiencies were noted on the Abell Howe jib hoist. (1) On or about December 9, 2004, in house inspections were not completed on a monthly basis. (2) On or about December 9, 2004, there were no annual, signed inspections. (3) On or about September 24, 2004, a bundle of forty foot long steel beams was not properly secured as they were being lifted and the carrier that the load was in shifted. As a result, the load hit into the employee, thereby causing injuries. In addition, there were no tag lines provided so that employees would not have to stand directly by loads that potentially shift in the carrier. (b) Facility; The following deficiencies were noted with hoists in the facility. (1) On or about October 7, 2004, and October 8, 2004, in house inspections of the hoists and chains were not completed on a monthly basis. (2) On or about October 7, 2004, and October 8, 2004, there were no annual signed inspections. (3) On or about October 8, 2004, some of the hoists in the facility were not marked with load capacities and load capacities were not legible. This condition existed in departments such as the Tie Down Department and Ceiling Build Area. (4) On or about October 8, 2004, some of the chains on the hoists were covered with a ceiling texture material that is sprayed. Potential damage and/or defects in the chains could not be readily observed. This condition existed in the Tie Down Department.
