Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to moving construction vehicles and were note wearing high visibility clothing: (a) Jobsite, Route 51 Aliquippa PA: On or about 10/13/04, employees working within the construction zone were not wearing high visibility warning garments. Among other methods, one feasible and acceptable means to abate this hazard is to require all employees, in a construction zone, exposed to vehicular traffic to wear high visibility garments.y
