Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: (a) Warehouse/Facility-wide - On July 6, 2004, employees operating Komatsu forklift trucks equipped with operator restraint systems (seatbelts), were not required to utilize restraints when moving loads. Among other methods, one feasible and acceptable abatement method to correct the hazard is to ensure operators wear restraint systems while operating the forklift trucks as stated in the American Society of Mechanical Engineers standard for Low Lift and High Lift Trucks, ASME B56.1-2000, section 5.3.19. No abatement certification or documentation is required for this item.
