Minn. Stat. 182.653 subd. 2: The employer did not furnish to each employee, conditions of employment and a place of employment free from recognized hazards which caused or were likely to cause death or serious injury to employees: The employer failed to render its workplace free of the hazard of drowning. The hazard of drowning is recognized by various sources. The hazard caused the death of one employee and was likely to cause death or serious physical harm to two other employees exposed to it. Moreover, several feasible means existed to eliminate or to materially reduce the hazard of drowning. Finally, the employer knew, or with reasonable diligence could have known, about the factual conditions that constituted the recognized hazard of drowning in this case.
