Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that an employee was exposed to struck by hazards from working in the swing radius of an excavator: a) In the vicinity of 101 Penn Avenue, Scranton, PA - A Bobcat 341 excavator with rotating superstructure was being operated in close proximity to a small dump truck. The area between the truck and excavator was not barricaded, marked or guarded to prevent entry, on or about July 18, 2006. ABATEMENT CERTIFICATION REQUIRED One feasible and useful method to correct this hazard is to provide barricades, warning lines or other effective recognized procedures to prevent access into the area of the swing radius of equipment/machinery.:
