North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to: Ref: American National Standard (ANSI) Z245.1-1992 para 6.2.3 (a) a)facility, route - employees collecting curb side and rural refuse were riding the side step of the front end loader type refuse truck while the truck was in motion. Among other methods, one feasible and acceptable abatement method to correct this hazard is to train employees in the safe operation of the truck and restrict employees while picking up refuse from riding the side step of the truck.
