Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by trailers being backed to dock doors by non-over-the-road vehicles known as shifters. a) 493 County Avenue, Secaucus NJ in the trailer yard. Employees were exposed to the hazard of being struck by trailers being backed up to dock doors. Violation occurred on or about 07/22/2004. Among other methods, one feasible means of abatement is to enforce the use of the UPS required load restraints or other effective means which would reduce the amount and size of the packages falling out of the trailer when the door is opened, thereby eliminating the presence of an employee other than the driver to be behind the vehicle. A work procedure with training should also be implemented to address loads that arrive without an effective means of restraint.
