Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards from falls from forklifts: a)100 7th Ave SW, Attalla, AL - On or about 7/20/04, forklift operators were not provided with and required to use restraint devices. Among other methods, one feasible and acceptable method is to comply with the requirements of the American Society of Mechanical Engineers document ASME B56.1- 1993, Safety Standard for Low Lift and High Lift Trucks, Section 7.39 Operator Restraint devices.
