Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The Employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that: a) Located on or adjacent to the drive through area of the bank structure employees were observed exposed to the hazards associated with being struck by, falls in excess of 12' and or aerial lift collapse or failure from a Genie Z 45/25 extensible and articulating boom aerial lift being used with a 23' wood truss load hoisted beneath the basket by the extended aerial lift boom in close proximity to unprotected employees standing on the drive through structures top plate. Among other methods one feasible and acceptable method to correct this hazards is to follow the operators manual and ANSI A92.5-1992 Boom-Supported Elevating Work Platforms, Section 8.10.12 not to use the aerial platform as a crane.rm
