Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of burns, broken bones, crushing injuries, and/or death as a result of storage tank rupture due to the employer's failure to establish an effective program of storage vessel inspection to determine corrosion rates, wall thickness and vessel fitness for duty. a)On or about 6/20/05, Waste and Fuel Oil Storage Area - Approximately sixteen atmospheric tanks used for storage of flammable waste oil, combustible diesel fuel and boiler condensate were not periodically inspected or tested to insure that the mechanical integrity of the vessels was maintained. Among other methods, a feasible and useful method of correcting this hazards include but is not limited to the following: 1) Establish an effective program of pressure vessel inspections that ensure the determination of probable corrosion rate and specification of maximum period between inspections performed in accordance with ANSI/API RP 575 "Guidelines and Methods for Inspection of Existing Atmospheric and Low-pressure Storage Tanks, Second Edition American Petroleum Institute Inspection Code." 2) Determine and use of inspection points for non-destructive testing. 3) Ensure that each vessel is provided with a readable nameplate in accordance with API 620 or 650 Vessel Codes.
