Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being ejected from or pinned under forklifts: On or about May 18, 2005 employees were observed operating forklifts without wearing the seatbelts installed in the vehicles. A feasible and acceptable method of abatement to correct this hazard is to retrain all forklift operators in the hazards associated with not wearing a seatbelt and to establish a written policy which prohibits the use of forklifts without wearing a seatbelt. The rule must also be enforced.
