Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards of being crushed and/or caught-by the skid steer loader or its parts while in operation: a.The employer did not take preventive measures to keep bystanders away from the work area while the skid steer loader was in operation while lifting and dumping loads of dirt, as required by NIOSH Alert "Preventing Injuries and Deaths from Skid Steer Loaders", February 1998, DHHS (NIOSH) Publication No. 98-117 and the New Holland Construction LS180 Operator's Manual. Among other methods, one feasible and acceptable method is to train heavy equipment operators to visually check the area for bystanders and other employees before operating machinery and barricade the area to prevent access, on or about 06/26/04.
