Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to an employee in that an employee was exposed to a crushing and /or struck by hazard: a). Taylor Road Water Main Project. On or about 5/19/04, an employee was observed riding on the bucket of a Komatsu WA300 front-end loader traveling east on Taylor Road and exposed to falling from the bucket and being crushed and/or struck by the loader. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD IS TO FOLLOW THE MANUFACTURER'S OPERATION & MAINTENANCE MANUAL WHICH PROHIBITS ANYONE FROM RIDING ON THE BUCKET OR ATTACHMENTS. NO ABATEMENT CERTIFICATION REQUIREDATION
