Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to THE HAZARD OF BEING STRUCK-BY THE LOAD: a)Loading Yard, on or about 5/22/04: Employees required to unload metal pipe from the forks of a John Deere, 544G front end loader while standing on top of a trailer, were not protected against being struck by the load. Among other methods, feasible and acceptable methods to correct this hazard is to: a)Block and brace material that is being loaded to prevent load shifts. b)Install uprights on the side of the trailer higher than the pipe that is being loaded in order to prevent pipe from rolling off the trailer. c)Use a front end loader attachment that is designed for handling steel pipe. d)Develop a standard written safety procedure for loading and unloading pipe. e)Eliminate employees from standing on the trailer while pipe is being loaded.
