Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck or crushed by metal pipe pilings that were being unloaded: Location: 9 New Main St. On or about: 6/13/05 a) A Komatsu WA380 Wheel Loader (serial # 45130) was being used to unload 60' long metal pipe pilings. The loader had a JRB Coupler with Construction Utility Forks attached. An employee was standing on top of the pilings that were on the flatbed trailer while signaling to the loader operator. The load on the forks was not secured. Among other methods, one feasible and acceptable abatement method to correct this hazard is to: (1) Use a loader that has a parallel tool carrier feature such as the Komatsu WA320PT- 5L and/or; (2) Use a pipe fork attachment that secures the load such as the JRB Pipe Forks or Double Top Clamp Pipe Forks. NOTE: Because abatement of this violation is already documented in the inspection case file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19.
