Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employmnent and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: a)On or about 05/13/2009 - yard, 30-01 Harper Street An employee was struck-by the arm of a Kamatsu PC228USLC hydraulic excavator while assisting the truck driver in loading and securing the excavator onto a low bed trailer for transport to a jobsite. The truck driver leaned forward from the seat, to the right, while attempting to pin point the location of an employee who was assisting him and leaned onto the left work equipment control lever (joystick) with his left hand simultaneously, which caused the arm to move. Among other methods, one feasible and acceptable method to correct this hazard is to follow manufacturer general and safety precautions which include (1) only allow trained and authorized personnel to operate the equipment; (2) before moving machine or its attachments be sure no one is on or near machine or in swing area; and (3) honk horn to alert people nearby. WRITTEN ABATEMENT CERTIFICATION IS REQUIRED PURSUANT TO 29 CFR 1903.19.
