Text For Citation: 01 Item/Group: 001 Hazard: CRUSHING
Section 5(a)(1): of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being crushed by a garbage truck backing up. a).On 05/10/07 at the back of 36-47 37th Street. Astoria NY An employee was standing in the back of truck # G5 Plate No 62333JS, throwing cardboard into the truck. The truck driver moved the lever for the compactor which engaged a power take off unit; the truck engine R.P.M went up and the truck was in the reverse position. The truck lurched back and crushed the employee. The backup alarm/lights were not working. Among other methods, one feasible and acceptable abatement method to correct this hazard is to: Follow the Owner's Manual. It states:" If any system or component does not pass Pre- and Post-trip inspection, it must be corrected before operating the vehicle." The employer must ensure that these procedures are followed. Follow the ANSI Z245.1 Mobile Wastes and Recyclable Materials Collection Equipment--- Safety Requirements, that states in section 6.1.5 Maintenance program, " Implementing a program for the maintenance of the equipment, which will incorporate the following elements: c) Ensuring that all required safety features are operational and functioning, repairing, prior to placing equipment into service, any reported malfunction or defect that affects the safe operation of the equipment." WRITTEN ABATEMENT CERTIFICATION IS REQUIRED.
