Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were from recognized hazards that were causing or likely cause death or serious physical harm to employees in that employees were exposed to: being crushed by stone slabs: A).On 03/26/06, in the building of 31-23 Vernon Blvd, Long Island City, NY Employees stand in the "fall zone" while handling unsecured stone slabs, stored horizontally on a bundle rack in order to attach a stone clamp to the center of the slab. Up to 13 slabs are stored between the posts. AMONG OTHER METHODS, FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD WOULD BE TO: 1. Use alternative method to lock/unlock the clamp to the slab from the end of the slabs, where employees will not be exposed to being struck or caught in if a slab falls. 2. Develop and implement safe slab handling procedures, specifically addressing separating slabs and attaching lifting devices, when loading and unloading slabs to prevent employees exposure to falling slabs. 3. Ensure maximum weights of the slabs allowed between two posts does not exceed the manufactures recommendation. ABATEMENT CERTIFICATION IS REQUIRED PURSUANT TO 29 CFR 1903.19.
