Section 5(a)(1): of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to caught in/between hazards. a).On or about 05/10/06 64th Ave & 251st Street. Little Neck NY Two employees were riding on the outside arms of the John Deere model 240 skid steer loader. Among other methods, one feasible and acceptable abatement method to correct this hazard is to: Follow the Operators & Safety Service & Maintenance Manual. It states that:" Keep Rider Off Machine. Only allow operator on machine. Riders are subject to injury. They may fall from machine, be caught between machine parts, or be struck by foreign objects. Riders may obstruct operator's view or impair his ability to operate machine safely." Employees should also be trained in the recognition of hazardous conditions. The employer must ensure that these safety-operating precaution are followed. WRITTEN ABATEMENT CERTIFICATION IS NOT REQUIRED.TION
