Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employee in that employee was exposed to fall hazards and being crushed as the employee was lifted in the grapple of an excavator: A)On or about 9/19/05: At Worksite Employee was lifted and lowered from the roof of a building as he squatted within and held on to the grapple of a John Deere excavator, Model 200CLC (Serial #FF200CX506339). The employee was not provided with any fall protection and was exposed to falling upto 10'. The employee was also exposed to being crushed in the event that the grapple closed. AMONG OTHER METHODS, FEASIBLE METHODS OF ABATEMENT INCLUDE: 1) Do not allow any one to ride within the grapple, bucket or any attachment of an excavator. 2) Properly train employees to understand the hazards of riding within the grapple, bucket or any attachment of an excavator. Reference: Operators manual, John Deere Excavator 200CLC: Section 1-3-Safety Operating Precautions: Keep Riders off machine and never use machine for lifting people. Section 2-2-Operation-Operating the Machine:Never use machine to lift people. ABATEMENT VERIFICATION IS NOT REQUIRED.
