Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by the wheel loader. a).On or about 08/17/05 - Recycling plant An operator was driving a CATERPILLAR 960F wheel loader with the bucket raised 38 inches off the ground obstructing his view. Among other methods, one feasible and acceptable abatement method to correct this hazard is to: Develop and implement a training program specifically addressing safe operating procedures for wheel loaders, as stipulated in the manufacturer's manual. The employer must ensure that these procedures are followed. The Operation & Maintenance Manual stated on the page 13 "Carry attachments close to the ground, approximately 40 cm (15 in) above ground level." b).On or about 08/17/05 - Recycling Plant The front windshield and side window of a CATERPILLAR 960F wheel loader were cracked and damager distorting the view of the operator. Among other methods, one feasible and acceptable method to correct this hazard is to replace the windshield and side window.
